The head of Fanoos Institute stated, “Ayatollah Asif Mohseni wrote a book on Islamic government. He also wrote a Risalah on political issues.”

On the Thursday morning, August 25, 2022, in the commemoration ceremony that was held on the third demise anniversary of Ayatollah Asif Mohseni titled the scientific conference “Approximation of Islamic denominations; theory to practice” in the Conference Hall of the Islamic Sciences and Culture Academy, while pointing out the Woman Studies, Mr. Mohammad Javad Borhani stated, “This branch of studies has a high status in the Islamic world, as well as all over the world. In Afghanistan, a lot of research has been done in this field, especially recently, when women’s issues became very important.”

He continued, “There are three approaches in women’s studies and women’s rights. The first is the extreme approach of feminists and new thinkers influenced by the western world. They seek the unconditional equality of men and women. Another point of view is the tradition that traditional Shia and Sunni scholars advocate. The third approach is a moderate view of women’s issues, which is the right approach. Ayatollah Asif Mohseni and Grand Ayatollah Fayyaz have proposed theories in this regard that are similar to each other.”

“A woman can become a mujtahid and issue a fatwa. But the fact that she can be considered as a source of emulation, is one of the disputed issues. Also, the judgment and political leadership of women is disputed. Ayatollah Asif Mohseni wrote “Women in Islamic Sharia” book. Grand Ayatollah Fayaz also wrote the book “Women in the Political System of Islam”. Both of them wrote books on Islamic governance. Ayatollah Asif Mohseni also wrote the book “Risalah on political issues”,” added the head of Fanoos Institute.

While referring to the views of Ayatollah Asif Mohseni and Grand Ayatollah Fayaz, Borhani said, “To study the views of these two sources of emulation about women, we must examine the intellectual principles. The first basis is the principle of equality in reaching to perfection. There is no difference between men and women to reach perfection. This issue is among certain things that all Islamic sources of emulation and ulama accept.”

“The second basis is the “commonality principle” or “commonality rule”. Referring to the concept that if we doubt whether an order of the Sharia is for women or men, the principle is that in that matter, the order of the Sharia is the same for men and women. Because there is no difference between men and women in religious duty. Of course, some rulings differ between men and women, but where there is doubt, the rule of commonality can be used. The third basis is the principle of Ebahah. This means that if we doubt whether something is haram or not and there was no narration on that matter, we can consider that thing as permissible,” he continued.

“The fourth basis, which can be seen both in the works of Ayatollah Asif Mohseni and in the works of Grand Ayatollah Fayaz, is not paying attention to the reputation of a fatwa or its consensus. Both of them issued many opposing fatwas. It is precedented that many scholars did not pay attention to the reputation of a fatwa where there is no narration about that. In the fifth basis, it should be said that neither Ayatollah Asif Mohseni nor Ayatollah Grand Fayaz paid attention to the weak news which are contrary to the certain experience of life,” Afghan scholar added.
